Action Alliance: Court gives INEC 7 days ultimatum to recognize Omoaje as National Chairman

Action Alliance: Court gives INEC 7 days ultimatum to recognize Omoaje as National Chairman
The Federal High Court sitting in Osogbo, the Osun State capital has given seven days ultimatum to the Independent National Electoral Commission (INEC) to recognize Hon Adekunle Rufai Omoaje as the national chairman of the Action Alliance (AA).

The court also ordered INEC to put the name of Omoaje on its portal as the authentic national chairman of the Action Alliance.

Delivering its ruling on the case filed by Omoaje over the non compliance of INEC to the judgment of the court delivered on 11th November, 2024 which ordered INEC to recognize all the National Executive Committee (NEC) members elected at the elective national convention of the party held in Abeokuta, the Ogun State capital in October, 2023 where he (Omoaje) emerged the national chairman of the party, the court chided INEC for its failure to respect its judgment.

The court in its earlier judgment had ordered INEC to put the name of Omoaje on its portal, having emerged the national chairman of the party at the elective national convention supervised by INEC.

However, INEC failed to comply fully with the judgment as it only put names of other NEC members on the portal, with the exemption of Omoaje's name.

But Justice Demi-Ajayi in her ruling on Thursday gave seven days ultimatum to INEC to comply fully with its judgment by putting the names of all NEC members of the party including Omoaje on its portal.

Justice Demi-Ajayi held that Omoaje was duly elected the national chairman of the party, hence the need for INEC to put his name on the commission's portal.

The court distinguished between partial and substantial compliance and  expressed worry that INEC did not comply fully with its  judgement, declaring that partial compliance is no compliance.

The judge said "filing of an appeal does not mean stay of execution. INEC ought to comply fully with the judgment of this Honourable court."

The court held that INEC has through its action shown lack of obedience, disrespect and lack of  submission to the court., stressing that the action of INEC shows bias.

The court therefore awarded a cost of #100,000 against INEC.
